Apia Health Insurance "$100 Gift Card offer"

  1. These Terms and Conditions apply to the GIO & Apia Health Insurance "$100 Gift Card offer" ("Offer"), and information on the Offer and how to claim forms part of these Terms and Conditions. By participating in the Offer, consumers agree to be bound by these Terms and Conditions.
  2. The Promoter is Australian Pensioners Insurance Agency Limited ABN 14 099 650 996 (Apia) ("Promoter").
  3. The Offer commences at 12:00 am (AEST) on 10 April 2017 and closes at 11.59 pm (AEST) on 14 May 2017 ("Offer Period").
  4. Under the Offer, the Promoter is offering one (1) EFTPOS prepaid card pre-loaded with AUD$100 credit. The pre-paid card will be issued by Edge Loyalty Systems (ELS) Pty Ltd ABN 96 138 299 288 and is subject to the terms and conditions of use of the relevant supplier(s), including debit card expiry dates (if any) and is not replaceable if lost, stolen or damaged ("Gift Card").
  5. To be eligible to receive the Gift Card, a person must meet the following criteria ("Eligible Recipient"):
    1. the person must hold a current personal GIO branded insurance policy, being: 
      1. a GIO Motor insurance policy (including: Comprehensive Car, Third Party Property Damage, Motorcycle, Caravan, Boat, but does not include Compulsory Third Party cover); and/or
      2. a GIO Home & Contents insurance policy (including: Contents only, Building only, Landlord, Strata); and/or
      3. a GIO Personal & Life insurance policy (including: Life Protect, Funeral, Accidental Injury, Accidental Death Plan, Bill Protect), (collectively referred to as "GIO Personal Insurance Policy"); and
    2. the person must have applied for, and purchased, any Apia Health Insurance Hospital or Combined Hospital & Extras Cover ("Eligible Apia Product") by calling 13 50 50 or one of the Promoter’s health specific 1800 phone numbers during the Offer Period (a person does not qualify for the Gift Card if they take out any other type of Apia insurance product); and
    3. the person must be the sole policyholder (singles policy), or the primary policyholder (couples and family policies), of the Eligible Apia Product; and
    4. the Eligible Apia Product must have a Policy Start Date between 12:00 am (AEST) on 10 April 2017 and 11.59 pm (AEST) on 14 May 2017; and
    5. the person must be a permanent resident of Australia who is 18 years or over as at the date the person applies for the Eligible Apia Product; and
    6. the Eligible Recipient must not be a current Apia Health Insurance policyholder at the time of taking out the Eligible Apia Product, or have taken out and cancelled an Eligible Apia Product 2 months before or during the Offer Period; and
    7. the first premium must have been paid for the Eligible Apia Product; and
    8. the person must continue to hold the Eligible Apia Product past the 30 day cooling off period, which applies from the date of join providing no claim is made; and
      1. the Eligible Recipient (and their immediate families) must not be an employee of the Promoter or nib health funds limited (nib), or their related entities or agencies associated with this Offer.
  6. Eligible Recipients who meet all of the criteria in clause 5 will be entitled to receive the Gift Card unless they notify the Promoter that they do not wish to participate in the Offer.
  7. Once a person has satisfied the criteria in clause 5, the Promoter will mail the Gift Card to the Australian residential address provided to the Promoter at the time of joining the Eligible Apia Product within 6-8 weeks after the Offer Period. Any posting and handling charges will be paid by the Promoter.
  8. Only one (1) Gift Card will be awarded per policy. If there is more than one policy holder (couples and families), the primary policy holder will be awarded the Gift Card. The Gift Card is not transferable or exchangeable or substitutable for cash and cannot be combined with any other offer from the Promoter or nib. If the Offer or redemption of the Offer causes the recipient to incur a tax liability, the recipient is liable for payment of such tax.
  9. The Eligible Apia Products are issued by nib health fund limited ABN 83 000 124 381 (nib) and the Promoter has been appointed by nib as its authorised agent to promote and distribute the Eligible Apia Products on nib's behalf, for which the Promoter receives a commission.
  10. A GIO Personal Insurance Policy referred to above is issued as follows:
    1. GIO Motor and Home & Contents policies are issued by AAI Limited ABN 48 005 297 807 trading as GIO;
    2. GIO Personal & Life insurance policies are issued by Suncorp Life & Superannuation Limited ABN 87 073 979 530 AFSL 229880 (SLSL), under the brand GIO, and are distributed by Suncorp Financial Services Pty Ltd ABN 50 010 844 621, AFSL 229885 (SFS).
  11. The goods and/or services provided by the Promoter through this Offer come with consumer guarantees under the Australian Consumer Law ("ACL") that cannot be limited or excluded by these Terms and Conditions. Except for this liability under the ACL and any other liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way in connection with this Offer.
  12. The Promoter reserves the right, subject to the ACL, to withdraw or substitute all or part of the Gift Card with another gift of equal or greater value.
  13. Once the Gift Card has been dispatched and to the extent permitted by the ACL, the Promoter will not be responsible for any delay to deliver the Gift Card.
  14. Proof of identity, residency and eligibility is at the discretion of the Promoter. In the event that an Eligible Recipient cannot provide suitable proof they may forfeit the Gift Card in whole and no substitute will be offered.
  15. The Promoter reserves the right to disqualify any persons that provide false information or who seek to gain an unfair advantage or to manipulate this Offer.
  16. The Promoter (subject to the ACL and State and Territory legislation) reserves the right to amend, cancel or suspend this Offer if an event beyond the control of the Promoter corrupts or affects the administration, security, fairness, integrity or proper conduct of this Offer.
  17. Personal information is being collected by the Promoter in order to facilitate the conduct of this promotion. For this purpose, personal information may be disclosed to selected third parties, including but not limited to agents, related entities, contractors, service providers, suppliers and, as required, to Australian regulatory authorities. Participation is conditional on providing this personal information. The Promoter will use and handle personal information collected as set out in its Privacy Policy, which can be viewed at Each Privacy Policy also contains information about how individuals may opt out, access, update or correct their information, how individuals may complain about the treatment of their information, and how those complaints will be dealt with.
